Ovie commitment to Privacy
The PCOS Nutritionist Limited, a registered New Zealand company, trading as Ovie (herein referred to as ‘Ovie’), is committed to managing personal information in accordance with the New Zealand Privacy Act 2020 and the Health Information Privacy Code 2020
This document sets out our policies for managing your personal information and is referred to as our Privacy Policy.
In this Privacy Policy, “we” and “us” refers to Ovie and “you” refers to any individual about whom we collect personal information.
This policy does not limit or exclude any of your rights under the Privacy Act. If you wish to seek further information on the Privacy Act, see www.privacy.org.nz.
Other terms may also apply to you and the information we hold about you. For example, if you are employed with us, you may have specific privacy terms in your employment contract with us.
For what purposes does Ovie collect, hold, use and disclose your personal information?
The purposes for which Ovie usually collects, holds, uses and discloses personal information depends on the nature of your interaction with us. This may include:
Administer your Account on our network;
Identify you as a user in our system;
Determine your health issues as accurately as possible;
Choose the non-invasive solutions that correspond with you best;
Give you the best recommendations;
Track your progress;
Adjust your recommendations based on your progress;
Respond to comments, requests and questions and provide customer service;
Improve the quality of experience when you interact with our Services, including the testing of different page designs to see which performs better;
Send you administrative email notifications, such as security or support and maintenance advisories;
Resolve disputes and/or troubleshoot problems;

What information does Ovie collect about you?
Customers and prospective customers
When you enquire about our services, complete our online questionnaire, subscribe to receive emails or signup to use our services a record is made which includes your personal information.
The type of personal information that we collect will vary depending on the circumstances of collection and the kind of service that you request from us, but will typically include:
your full name
your email address
your health information and relevant symptoms which are necessary for us to provide our services to you
When you subscribe to our services, our third party payment provider Stripe, may also collect additional information to process your payment, such as your billing address and card details. Ovie does not hold this information in our databases.
Prospective employees/applicants
We collect personal information when recruiting personnel, such as your name, contact details, qualifications, and work and study history.
Before offering you a position, we may collect additional details such as your tax file number and superannuation information and other information necessary to conduct background checks to determine your suitability for certain positions (for example, positions which involve working with patients).
Business contacts
We collect information when we do business with you. The personal information that we generally collect may include:

Subscribing to our newsletter (if any);

Participating in a promotion, event, contest or online forum, or by filling out a questionnaire or survey related to our Services;
Registering for an Account;
Participating in a social media activity related to Ovie and our Services by clicking “like” or “share”;

What legal grounds apply for processing your information?
We will only process your personal information where we have a legal basis to do so. The corresponding legal grounds for the processing of personal information for the above purposes are:
You have given us consent to process your personal information (for example if you have subscribed to receive emails from us, you have completed an online survey or quiz, or if you have agreed to supply of our Services);
Processing is necessary for the performance of a contract with you, or to prepare entering into a contract with you at your request (for example, if you place an order);

What happens if your personal information is not provided to Ovie ?
If you do not provide us with the information we request, we may not be able to fulfil the applicable purposes of collection as described above, such as to supply our Services to you, or respond to your requests or enquiries, or tailor our website, or Services in the most beneficial way.

How does Ovie Hold Information?
Ovie takes reasonable steps to protect your personal information from misuse, interference, and loss and from unauthorised access, modification, or disclosure.
We protect your personal information with a variety of security measures. This may include, but are not limited to, using secure registration forms, encryption of data, and restricting access to your personal information
We store information in secure databases (including trusted third-party storage providers) based in Australia for all personal and symtpom information.
A small subset of contact information to support sales and marketing activities is managed and stored using a service provider in the USA.
How does Ovie interact with you via the Internet?
Third Parties that Provide Content, Advertising or Functionality
Certain third parties may serve advertising or keep track of which advertisements users see, how often they see those advertisements, and what users do in response to them; and
We may enable you to share certain materials on the websites and services we offer with others through social networking services such as Meta, (Facebook and Instagram), Google, TikTok and LinkedIn.
Third parties that provide content, advertising or functionality on our websites and services may collect or receive certain information about your use of these websites and services, including through the use of cookies, beacons, and similar technologies, and this information may be collected over time and combined with other information collected across different websites and online services. Some of these third parties participate in industry-developed programs designed to provide consumers with choices about whether to receive targeted advertising.
If you connect with a social networking service while using one of our websites or services, we may receive and store authentication information from that social networking service to enable you to log in, as well as other information that you allow us to receive when you connect with these services.

Beacons

Does Ovie use or disclose your personal information for direct marketing?
Ovie may use or disclose your personal information for the purpose of informing you about our services, upcoming promotions and events, or other opportunities that may interest you.. If you do not want to receive direct marketing communications, you can opt-out at any time by using the unsubscribe link in any of the communication sent you. .
If you opt-out of receiving marketing material from us, Ovie may still contact you in relation to its ongoing relationship with you, especially in relation to the Services you’ve subscribed to.
How can you access or seek correction of your personal information?
You are entitled to access your personal information held by Ovie on request. To request access to your personal information please contact our Privacy Officer in writing using the contact details set out below.
You will not be charged for making a request to access your personal information, but you may be charged for the reasonable time and expense incurred in compiling information in response to your request.
We will take reasonable steps to ensure that the personal information we collect, use or disclose is accurate, complete and up-to-date. You can help us to do this by letting us know if you notice errors or discrepancies in information we hold about you and letting us know if your personal details change.
However, if you consider any personal information we hold about you is inaccurate, out-of-date, incomplete, irrelevant or misleading you are entitled to request correction of the information. After receiving a request from you, we will take reasonable steps to correct your information.
When you contact us to request access to and correction of your personal information, we may need to verify your identity. When you submit your request, please include your full name, and contact details, and set out the details of your request (such as the personal information you would like to access or the correction you would like to make).
We will take reasonable steps to notify you of a decision on the request within 30 days. We may decline your request to access or correct your personal information in certain circumstances in accordance with the Privacy Act. If we do refuse your request, we will provide you with a reason for our decision and, in the case of a request for correction, we will include a statement with your personal information about the requested correction.
What should you do if you have a complaint about the handling of your personal information?
You may contact Ovie at any time if you have any questions or concerns about this Privacy Policy or about the way in which your personal information has been handled.
You may make a complaint about privacy to the Privacy Officer at the contact details set out below.
The Privacy Officer will first consider your complaint to determine whether there are simple or immediate steps which can be taken to resolve the complaint. We will generally respond to your complaint within a week.
If your complaint requires more detailed consideration or investigation, we will acknowledge receipt of your complaint within a week and endeavour to complete our investigation into your complaint promptly. We may ask you to provide further information about your complaint and the outcome you are seeking. We will then typically gather relevant facts, locate and review relevant documents and speak with individuals involved.
If you are not satisfied with our response to your complaint, or you consider that Ovie may have breached the Privacy Act, a complaint may be made to the New Zealand Privacy Commissioner (by telephone on 0800 803 909 or by email at enquiries@privacy.org.nz).
How are changes made to this Privacy Policy?
